<p>How ironic that on this the Fourth of July weekend in which we celebrate our nation&#8217;s independence, law enforcement agencies across Texas are gearing up to violate our freedoms and rights under of the Fourth Amendment of the U.S Constitution.  In Texas, I guess it&#8217;s alright for law enforcement officers to poke a needle in your arm against your will, but its not ok for TSA agents to conduct pat downs at the airport.  I would take up a pat down over someone poking a needle in my arm against my will any day.  When is the public going to wake up and see that both are violations of our rights and freedoms!  When are we going to learn that the need to feel safe and secure does not give the government the right to infringe and tread upon our rights and freedoms given to us.  Of course, there are many Texans and Americans in general that often willingly throw away their rights because some government official or some organization with some agenda tells you its for your safety and security that we take your freedoms.  Once they take your rights away, do you think they are going to willingly give them back to you?  So as you are celebrating the Fourth of July this holiday weekend, ask yourself are you a person that celebrates and cherishes our freedoms, or are you one that is ready and willing to give yours away at every request of the government.       </p>

			<content:encoded><![CDATA[<p>DPS provided many Texans with some added relief this week by approving new surcharge programs meant to provided amnesty or relief to Texas drivers that have incurred several hundreds or thousands of dollars in surcharges under the DPS Driver Responsibilty Program.  Under this program, Texas drivers are subject to incurring surcharges for a number of violations included DWI, DUI, driving while license invalid &#8220;DWLI&#8221;, no drivers license, failure to maintain financial responsibility, and been convicted of to many traffic violations (having more than 6 points) within a three-year period of time.  Failure to pay these surcharges results in a suspension of an individuals driver&#8217;s license.  Frankly, many people lack the financial ability to pay these surcharges, and thus have their driver&#8217;s license suspended by DPS.  This of course can led to additional problems for drivers that are arrested/charged with driving while license suspended &#8220;DWLS&#8221;, such as additional court costs, additional suspensions, fines, and potential jail time.  </p>
<p>The new changes in the surcharge program are intended to allow drivers an opportunity to pay off the surcharges at a reduced amount and in some cases rescind the driver&#8217;s license suspension.  There are three different types of programs that were approved by DPS:  amnesty program; indigency program; and the incentive program.  These programs are going to be &#8220;phased-in&#8221; over the next year or so.  More details of the program are provided in the link below.</p>

<p>Apparently, someone has failed to inform Chief Acevedo that current Texas DWI law allows for an individual with a BAC under 0.08 to be prosecuted here in Texas.  Just refer to the the definition of &#8220;intoxicated&#8221; under <a href="http://www.statutes.legis.state.tx.us/Docs/PE/htm/PE.49.htm#49.01">Section 49.01(2) of the Texas Penal Code</a>.</p>
<p>This is just an attempt on the part of law enforcement and prosecutors to make it easier to obtain convictions in DWI cases, by trying to lower the statutory limit of intoxication under Section 49.01(2)(B) from a BAC of 0.08 and above, to between 0.05 and 0.07.  I really hope that the citizens of Texas and the State legislators have sense to realize this proposed legislation is totally unnecessary, and would only led to more citizens being falsely accused/arrested of DWI and more of individual rights being violated.  The real agenda is to someday make it illegal to drink any amount of alcohol and drive, although your ability might not be impaired at all.  Law enforcement and prosecutors need to push for better evaluation of DWI cases and training, not for unneccessary and unwanted &#8220;DWAI&#8221; legislation.   </p>
